  • When clients are first sued or realize that they must sue, they feel pressed to select attorneys immediately. Often they default to their corporate or patent counsel. They think that they only have a few days to "answer." Clients can obtain additional time to choose their team. They should take this time, unless an injunction is involved. In that case they must act with speed, but the choices become even more important to success. Allegiance will obtain extensions of time to answer, or file an answer and start the initial procedures. The client has more time to assemble the best team.

Pick a team, not a law firm

  • Winning and losing is in the details. If these details, such as document review, legal analysis, technology analysis, or depositions, are done by the wrong person, it doesn't make any difference if the law firm, or the lead attorney, is great. Each of these tasks require specific skill sets and experience. Allegiance advises on assembling a team, from top to bottom, that includes the necessary skills and experience.

  • Firms don't always get the best consultants, experts, and other outside services. The firm may favor its established relationships over the best choice, or it may simply not devote sufficient effort to the search. Allegiance can help identify the right consultants and experts. Experts are extremely important in high tech cases.

  • Choosing the right attorneys requires asking the right questions. Allegiance knows the questions from the inside, and it knows the answers that make sense. The right team may come from two or more firms. Several skills are needed for high tech IP litigation. A client should avoid reputations based on public relations and get experience and skill that are relevant.

Avoid the dangers of overbooking

  • Many of the best known law firms are constantly overbooked. This overbooking is a natural result of the firm's business imperatives. However, they are never too busy to take on yet another case. Particularly with existing clients or new, desirable, clients, the firm would rather overwhelm itself than say "we're too busy to handle your case." As a result, a firm is constantly juggling its commitments. Allegiance monitors to see that the case does not get hurt due to lack of work done at the right time.

Ensure that client goals are given priority

  • Allegiance will know the whole team on your case, not just the leader. Allegiance will work to keep valuable members on the team, even if the firm wants to shift them to another matter, or even if they go to another firm. Accumulated knowledge in a case that lasts more than 6 months, and up to several years, is extremely important and valuable. Allegiance will insure that important work is being done by attorneys, or others, with the proper skills.

  • Allegiance can establish methods for a client to do some or all of its own document or paralegal work. In a big case this will save tens of thousands of dollars.
